Changes to the ARM Rules, which entered into force on July 5th, 2021:
The changes were introduced by a Resolution of the Management Board of KDPW S.A. 817/2021
of June 21th, 2021, according to which the unified access system has been included as a mean of electronic communication with ARM. Thus, in the U2A channel from July 5th to the end of September this year, two interfaces will function, the new ARM approved reporting mechanism
application (GUI to ARM system) and the existing ESDIweb. From October 1st, 2021, communication of ARM participants with the ARM system within the U2A channel will be possible only via GUI.
Bearing in mind the above, we encourage persons authorized by ARM Participants to apply via an access account in the application https://online.kdpw.pl
for the role of an administrator in the ARM approved reporting mechanism service, i.e. a person authorized to have access to grant other persons further powers of attorney to communicate directly with ARM system, as well as to revoke such powers of attorney by granting or denying them access to the ARM system, respectively. The possibility of applying for the administrator role will be made available on July 5th, 2021. with the entry into force of amendments to the ARM Rules. In order to maintain the continuity of access to the ARM system in the U2A channel, please submit applications without undue delay, so that at the end of September this year had the ability to independently manage the rights of GUI users.
Also a provision has been introduced to the amended ARM Regulation that allows to provide information about the amendments to the ARM Regulations using e-mail. Pursuant to the new provisions, the information on the amendment to the ARM Regulations provided to the e-mail address of the person authorized by the participant to gain access to the ARM application is deemed effectively delivered to that participant.
We would like to draw your attention to the fact that, since January, 1th 2022, the rate of maximum fees for participation and reports will also be changed. The new maximum fee, so-called CAP, will be 3,650 PLN net. This fee applies up to the level of 1 million transaction reports per month submitted on behalf of the single Investment firms. Above this volume, a fee of 0.001 PLN net will be charged for each report. The change in the rate is dictated by a significant increase in the volumes of reports processed by the ARM KDPW.
